After the passing of the Surrogacy Act in 2016, commercial surrogacy was also banned there. Not only that, in 2016, a bill called the Surrogacy Control Act 2016 was brought to Parliament to ban commercial surrogacy. It described the process of renting wombs as unethical and said that the rich are taking advantage of the weakness of poor and uneducated women in the absence of laws. In other words, surrogacy clinics have become mere baby factories for the rich.
However, IVF surrogacy is still in operation. According to the proposed bill, surrogacy is legal for Indian couples who are unable to bear children despite sincere efforts. However, they have to submit a medical certificate of inability to produce children. In this case, the age of the wife should be between twenty-three and fifty and the age of the husband should be between twenty-six and fifty-five years.
